Evaluating the significance of the move towards 'soft law' for the institutions — who wins, who loses?

In the light of the above discussion, in this section the focus is more specifically on the impact of subsidiarity for the six institutions described. In particular in relation to examining its importance for the ECJ, the hypothesis on justiciability is addressed, as is the idea of subsidiarity being a 'federal' principle. However, more generally speaking it is possible to sketch out below institutional 'winners' and 'losers' under subsidiarity. Equally it is clear from the above considerations that subsidiarity directly affects some institutions more than others, for instance as it is chiefly concerned with justifying legislation and action, its main target is clearly the Commission who alone enjoys the right of initiative. Yet what of the environment directorate-general, DG XI, then? Is it a winner or loser, and what would that mean?
